DAPINET PROJECT. THE WEBSITE OF NETWORKED INTELECTUAL PROPERTY

A worldwide approach on Intellectual Property

 

In the early times of Internet, the District Court of Columbia stressed, in a landmark decision, that “[…] the Internet ha[s] created ever-increasing opportunities for the exchange of information and ideas in ‘cyberspace’. This information revolution has also presented unprecedented challenges relating to rights of privacy and reputational rights of individuals, to the control of obscene and pornographic materials, and to competition among journalists and news organizations for instant news, rumors and other information that is communicated so quickly that it is too often unchecked and unverified.” The Court went on and said: “Needless to say, the legal rules that will govern this new medium are just beginning to take shape.” See Blumenthal v. Drudge and AOL, 992 F. Supp. 44, 49-53 (D.D.C. 1998).

 

Since then, Internet is raising new potential risks relates personal data protection and privacy carried out by search engines, hosting services or content providers, including cloud computing services; reputation and one´s own image, or dissemination of hate propaganda or child pornography using tools, applications and services provided by the Internet; and also intellectual property issues.

 

Additionally, traditional media are undergoing a radical evolution to face the online driven competitors for media consumption, -Youtube, social networks, wikies and blogs- which facilitate public access to communication platforms with a global reach. For these reason, traditional media are trying to adapt their business models and their know-how to 2.0 tools. In such a context, these new media and platforms are raising new legal issues relating to intellectual property issues. Recent cases are showing big online legal intellectual property concerns.

 

In Apple versus Samsung patent dispute more than 30 claims and counterclaims have been taken place only in the US jurisdiction. The so-called Google´s fee encouraged by Angela Merkel´s Cabinet may require the giant search engine and other aggregators to pay for reproducing content from news websites. The far-reaching implications of imposing 2.0 platforms, such as social networks, to install filtering systems in order to prevent present and future intellectual property infringements from being committed could be inconsistent with European Directives if those systems entail costly measures for Internet Service Providers, personal data infringements or even chilling effects on freedom of speech, as recently stated the European Union Court of Justice in Sabam vs. Netlog (2012).

 

Furthermore, since Napster case (2000), Internet is a common place where on line piracy by file-sharing throughout peer to peer networks have raised controversial issues about how to balance the protection of copyrighted works or author´s intellectual property and the right to access to culture. Recently, in one of the largest criminal copyright cases ever brought, the US Justice Department and the F.B.I. seized the Web site Megaupload (2012) and charged seven people connected with online international piracy.

 

In such context, DAPINET, as its Spanish acronym refers (Derechos de Autor y de la Propiedad Intelectual en Red), represents a collaborative and online research project jointly undertaken by Phd. and Lecturer on Information and Media Law, Estrella Gutiérrez David, and those students of the specific Course on Intellectual Property taught at Centro de Estudios Superiores Felipe II, affiliated to the Universidad Complutense de Madrid. Since 2006 to present day, DAPINET Project has been divulgating papers, both in Spanish and English, written by students -guided and assessed by the main researcher Phd. Gutiérrez. These papers are focused on different legal aspects of intellectual property raised in off-line and online context, assuming a comparative and international approach on civil law and common law jurisdictions.

¿Quiénes Somos?

PROYECTO DAPINET. EL SITIO WEB DE LA PROPIEDAD INTELECTUAL EN RED

DAPINET, Derechos de Autor y de la Propiedad Intelectual en Red, representa un proyecto conjunto entre la profesora Dra. Mª Estrella Gutiérrez David y alumnos de la Titulación de Comunicación Audiovisual en el CES Felipe II (UCM), que aborda el estudio de los derechos de autor en el ámbito del sector audiovisual y de las nuevas tecnologías. La estructura del sitio web responde a estos propósitos al incluir distintas secciones relativas a la legislación sobre derechos de autor, análisis de sentencias relevantes, reseña de noticias actuales en la materia, artículos de investigación, un diccionario con términos clave, así como preguntas frecuentes.

 

El proyecto DAPINET se lleva desarrollando desde el curso académico 2006/2013 y consiste en el estudio y análisis de los problemas jurídicos actuales que plantea la protección de los derechos de autor, entre otros, la determinación de la autoría, la contratación audiovisual y el reconocimiento de la propiedad intelectual, el canon por copia privada, las Redes P2P y el intercambio de archivos, los sistemas DRM, las formas de protección (medidas cautelares, protección civil y penal, el Registro de la Propiedad Intelectual), las entidades de gestión.

 

La forma de investigación y trabajo que configura el Proyecto DAPINET comporta el planteamiento teórico a modo de sesiones magistrales, y el desarrollo práctico por parte de los alumnos, consistente en un prácticum que comprende básicamente la realización de un trabajo investigación tutorizado por el profesor sobre una cuestión de actualidad con relación a los derechos de autor.

 

Los objetivos básicos del Proyecto DAPINET son por un lado la creación de material didáctico sobre la asignatura generado por los propios alumnos  y, por otro, generar el valor añadido de una publicación en línea editada por los estudiantes.
